Upholding Democracy: Ensuring Fairness in the Electoral Process

The cornerstone of a thriving democracy lies in the conduct of credible elections that are not only timely but also free and fair. Unfortunately, the history of elections in our nation has been marred by challenges in achieving these fundamental principles. As we approach the upcoming elections in February, concerns about the fairness and transparency of the electoral process have taken center stage, casting a shadow over the democratic landscape.

Recent interventions by the Supreme Court have quelled doubts about the timely holding of elections, providing a semblance of stability. However, a critical question looms large regarding the fairness of the electoral process, with the Pakistan Tehreek-e-Insaf (PTI) alleging a systematic erasure as a political entity by the state. These claims, supported by compelling evidence, demand careful consideration to ensure the integrity of the democratic process.

One of the significant setbacks faced by the PTI was the rejection of its intra-party polls by the Election Commission of Pakistan (ECP) and the denial of its iconic bat election symbol. While the Peshawar High Court's recent suspension of the ECP's decision offers a temporary reprieve, the lingering uncertainty necessitates swift judicial action. Legal observers posit that the ECP may pursue intra-court appeals or petition the apex court, emphasizing the urgency of expediting the hearing to resolve the PTI's symbol predicament.

To maintain the sanctity of the democratic process, it is imperative that all political contenders, including the PTI, are afforded a level playing field. Beyond the courtroom battles, the PTI alleges mistreatment, as evidenced by the recent incident involving the manhandling and rearrest of PTI Vice Chairman Shah Mahmood Qureshi. Additionally, the party has filed a contempt petition, citing violations of the court's orders by the ECP and seeking an end to the harassment of its members.

The democratic journey of our nation has witnessed obstacles thrown in the path of various political parties in the past, from the National Awami Party to the PPP and the PML-N. Now, it is the PTI's turn to confront challenges that threaten the essence of democratic principles. This recurring subterfuge of the democratic process must cease, and every political party should be granted the freedom to campaign without hindrance.

In upholding the spirit of democracy, it is essential that the run-up to elections and polling day remain free from violence and intimidation. Violations of the constitution and infringements on fundamental rights only serve to undermine the very foundation of our democratic ideals. The pillars of the state must act responsibly, avoiding acts of omission and commission that further delay the electoral process or manipulate its results.
