Supreme Judicial Council Faces Controversy as Justice Naqvi Seeks Recusal of Key Members

In a dramatic turn of events, Justice Sayyed Mazahar Ali Akbar Naqvi has sought the recusal of three members of the Supreme Judicial Council (SJC), including Chief Justice of Pakistan (CJP) Qazi Faez Isa, who are set to hear misconduct complaints against him. The move comes as Justice Naqvi alleges bias and political motivations behind the proceedings against him, raising questions about the integrity and transparency of the justice system in Pakistan.

Allegations of Bias

In his preliminary reply to a show cause notice issued by the SJC on October 28, 2023, Justice Naqvi objected to the participation of CJP Isa, Justice Sardar Tariq Masood, and Justice Naeem Akhtar Afghan, claiming that their involvement taints the proceedings with bias. He argues that the interests of justice and due process dictate that these senior judges should recuse themselves from the case.

Justice Naqvi's contentions are rooted in past actions and statements made by CJP Isa, particularly his opposition to Justice Naqvi's nomination as a judge of the apex court. Justice Naqvi also points to a letter written by CJP Isa and Justice Masood, requesting the expedited handling of the complaints against him, which he interprets as a sign of bias.

Controversial Audio Leaks

A significant aspect of the complaints against Justice Naqvi revolves around alleged audio leaks. Nine out of the ten complaints against him rely on these recordings, the authenticity of which has not been established. Notably, an inquiry commission was established by the Federal Government to investigate the veracity of these audio leaks. Curiously, CJP Isa was appointed as the Chairman of this commission, and Justice Naeem Akhtar Afghan, another member of the SJC, was also appointed as a member of the inquiry commission. However, the proceedings were subsequently suspended by the Supreme Court of Pakistan.

Justice Naqvi's argument is that the same audio leaks referred to in the inquiry commission are being used as the basis for the complaints against him in the SJC, creating a potential conflict of interest.

Justice Masood's Involvement

Justice Naqvi has raised concerns about Justice Sardar Tariq Masood's involvement in the case, highlighting that he has already formed an opinion on the matter and that the submission of his report was deliberately delayed until after the retirement of Chief Justice Umar Ata Bandial. Moreover, Justice Masood has allegedly used derogatory language against Justice Naqvi and disclosed the outcome of the SJC proceedings at the oath-taking ceremony of Justice Irfan Saadat Khan. Justice Naqvi argues that these actions and statements demonstrate bias and compromise the fairness of the proceedings.
